TIBCO sues...and it’s not Microsoft

Middleware provider TIBCO Software filed suit against Apple Computer this week for trademark infringement on its Rendezvous registered trademark. The suit was filed in the District Court for the Northern District of California. It alleges that Apple carried out acts infringing on TIBCO's trademarks with the intention to trade on TIBCO's goodwill and harm TIBCO's business. TIBCO wants justice for Apple’s alleged use of the Rendezvous trademark for a similar software product, despite knowing that TIBCO has used the name since 1994. TIBCO chief marketing officer, George Ahn said his company tried to reach a settlement with Apple but the company has refused.
