D.C. Circuit rejects LNP stay request

The U.S. Court of Appeals for the District of Columbia Circuit this week rejected a request made by the U.S. Telecom Association for an emergency stay of the Federal Communication Commission's wireline-to-wireless number portability order. The USTA has challenged the order on appeal because the FCC failed to address technology and procedural issues that the trade group said prevented wireless customers from porting to wireline carriers in most markets. Though disappointed with the court's decision, USTA President and CEO Walter McCormick said in a statement that the trade group ultimately will prevail on the merits of its appeal.
