New legislation proposed for digital age

Senate Republican Jim DeMint from South Carolina, a member of the Senate Commerce Committee, introduced new legislation yesterday that he claims would create a market-oriented, competition-based communications regulation system.

The Digital Age Communications Act (DACA) would treat communications companies like other companies and focus on protecting consumer rights and monitoring unfair competition, according to DeMint's press release.

The DACA would make all providers of like services, voice for example, subject to the same regulations. It also would reform the Universal Service Program by making all service providers contribute equally and distribute funds more efficiently and transparently.

The legislation would phase out cable television franchises over the next four years. States would still be given authority to enforce federal rules and manage public rights-of-way.

DeMint said that Congress must wake up to the idea that as communication technologies are growing and mediums are merging, a new system is needed that protects consumers while allowing businesses to thrive.

"This bill will create an environment that encourages innovation and competition. Americans understand that when businesses are allowed to compete, they win," DeMint said in a statement.

BellSouth applauded the proposed legislation. Herschel Abbott, vice president of government affairs for BellSouth, said the legislation was forward looking and designed to assure that market forces and competition replace the outdated regulatory forces that continue to hold our industry back.

"We are particularly pleased with the bill's focus on further clarifying the role that state commissions should play in regulating the industry," Abbott said.
